ORDER INFORMATION

Your credit card details are encrypted and sent securely using SSL - the Internet standard for secure transfers. Your order will be uploaded to the Kristal Digital Server via your normal Internet Service Provider (ISP). Depending on your ISP contract you may incur communication or connection charges during the upload. After your order is submitted the credit / debit card payment will be authorized by WorldPay. Your order will then be passed on to the Kristal Digital Imaging Centre Laboratory for processing. The payment will be shown on your credit card statement as Kristal Digital Imaging Centre or Kristal

SERVICE QUALITY – DIGITAL

Your pictures will be printed on high quality digital processing equipment. As with all digital pictures, the quality of the print depends on the amount of data (number of pixels) in the original image. If you have used a low quality picture or if you have zoomed in or cropped too much, the software will have warned you that the resulting prints may be of bad output quality. Despite these warnings we do let you order the print. Please include your order number (shown in the acknowledgement email and the completed order list) in any correspondence.

SERVICE QUALITY – FILM

It is impossible for the Company to assess the value of originals and unprocessed film supplied by the customer and the charges made for our services do not reflect or incorporate unlimited liability. Customers should insure work of special value and advise us accordingly. All orders for processing and printing are accepted on the basis that their value does not exceed the cost of equivalent new unprocessed material. In the unlikely event of loss or damage, whether caused by negligence or otherwise, liability is limited to the cost of an equivalent amount of unexposed film and refund of any processing charges paid.

TERMS & CONDITIONS

Order Acceptance: Photo print orders will only be accepted under the Terms & Conditions outlined herein. All data should be securely saved by the customer beyond the time of placing the order. We do not save or keep the data transmitted by the customer after printing and delete all order related digital data with order fulfilment. The customer is not allowed to upload, email to us or order prints of any images or other material which contain: - nudity or pornographic or obscene or sexually inciting material; - racist or extremist material; - material that is likely to incite hatred against any person or group; - blasphemous material; - defamatory or otherwise actionable material; - images of any criminal act; - material the use or inclusion of which infringes any copyright, trademark or other intellectual property right of any third party; - material that breaches any applicable laws or legislation. If we entirely at our discretion decide that this provision is or is likely to be breached then we shall be at liberty to delete the data transmitted. To be eligible to submit an order the customer must be at least 18 years of age and the authorised owner of the credit / debit card being used for payment.

Property Rights: The customer herewith confirms that he is responsible for the content of photos transmitted and is entitled to transmit and print the images. The customer agrees when placing orders that he will only use the services of Kristal Digital Imaging Centre and its partners in a manner that is consistent with these Terms & Conditions and in a way that complies with all applicable laws and regulations. The customer will indemnify and hold harmless Kristal Digital Imaging Centre, its partners, officers, directors, employees, agents, licensors, suppliers and any third party and providers to us from and against any or all losses, expenses, damages and costs including legal fees resulting from any violation of the Terms & Conditions, or any activity relating to the customers account by the customer or any other person that uses the services through the customer’s account. Disclaimer: All liability for loss or damage suffered due to either the loss of any data transmitted before or after printing or a delayed delivery of the item/s, whether this loss is caused by us or by a third party is expressly excluded. Delivery: We shall strive to dispatch orders within one week but are under no obligation to do so. Our dispatch audit systems serve as proof of posting. If the option to collect the order from the store is selected, Kristal Digital Imaging Centre will hold all orders for a maximum of 3 months, unless prior notification has been provided at time of the order, after which all such materials including originals, negatives, positives and digital media will be destroyed.

If an order becomes lost in the postal system, we will re-send the order, once 10 working days has passed since we dispatched the items, for which we may request the customer to resubmit the order data. Should the second package dispatched also become lost our liability shall cease. If we have sent the customer’s order again and either the package is returned to us for non collection from a sorting office or an incorrect/incomplete address has been provided then the postage cost is payable again and we are hereby authorised to debit the card used for payment with such cost. We will not be held liable for any non-delivery of orders shipped by us to an address outside the European Union. Guarantee: Any complaints, as far as visible faults are concerned need to be presented by the customer within two weeks of receipt of goods. Non-visible faults are covered for six months by the consumer warranties as defined in any applicable laws or legislation. In no event shall Kristal Digital Imaging Centre or its partners’ maximum liability, under any circumstances whether based on action or claims in contract or in tort (including without limitation negligence and strict liability) exceed the purchase price of the print order. Law and jurisdiction: These terms (and the provision of goods and services by us) are governed by and to be interpreted in accordance with the laws of England & Wales.

In the event of any dispute arising in relation of these terms or in relation to the provision of any goods and services by us the English courts will have exclusive jurisdiction over such dispute. If your correspondence is related to a specific order please include your order number (shown on the order confirmation slip and in the order acknowledgement e-mail).

PRIVACY POLICY

This privacy statement covers the Kristal Digital Imaging Centre. If users have questions or concerns regarding this statement, they should contact the Kristal Digital Imaging Centre by email – support@kristal-photos.com. We aim to reply to your query within 3 working days of receipt. If users do not receive acknowledgement of their inquiry or their inquiry is not satisfactorily addressed, they should then contact our Customer Services Department at the address shown at the foot of this page.

 

 

INFORMATION COLLECTION AND USE

Information Collection - Kristal Digital Imaging Centre is the sole owner of the information collected via the Kristal digital imaging centre. We request information from the user on our order form. A user must provide contact information (such as name, email, and delivery address) and financial information (such as credit card number, expiry date). This information is used for billing purposes and to fulfil customer’s orders. If we have trouble processing an order, the information is used to contact the user. Information Use - We use the following information in order to process your order from our e-commerce site: Full Name, including title, Address, Telephone number, Email Address. Cookies - A cookie is a piece of data stored on the user’s computer tied to information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. We use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user’s hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. We have no third-party cookies on our website, nor do we share the information recorded in them with anyone. Third Party Advertising - We do not have ANY third party advertising on our site. Log Files like most standard Web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information.

 

 

COMMUNICATIONS FROM THE SITE

Service Announcements - On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance we might send users an email. Generally, users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature. Customer Service - We communicate with users on a regular basis to provide requested services and in regards to issues relating to their account. We reply via email or phone, in accordance with the user’s wishes.

SHARING - Legal Disclaimer

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site. Aggregate Information (non-personally identifiable) - We share aggregated demographic information with our partners and advertisers. For example, we may pass details to our suppliers of the number of users looking at/purchasing their products, or the number of click-through from their own sites. This is not linked to any personally identifiable information. We DO NOT Share Personal Information with Third Parties, except for the purposes of Credit/Debit card authorisation, and delivery. Third Party Intermediaries - For the purpose of credit/debit card authorisation we will pass your name and address to our Bank. For the purpose of delivering your parcel we will pass your name and address to Parcel force, or another one of our parcel carriers. These companies do not retain, share, store or use personally identifiable information for any secondary purposes. Service Providers - In the event that Kristal Digital Imaging Centre goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, users’ personal information will, in most instances, be part of the assets transferred. Users will be notified via a prominent notice on our Web site for 30 days prior to a change of ownership or control of their personal information. If as a result of the business transition, the users’ personally identifiable information will be used in a manner different from that stated at the time of collection they will be given choice consistent with our notification of changes section. Choice/Opt-out Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications by replying to unsubscribe in the subject line in the email or email us at support@kristal-photos.com

Security - Kristal Digital Imaging Centre takes every precaution to protect our users’ information. When users submit sensitive information, their information is protected both online and off-line. When our registration/order form, asks users to enter sensitive information (such as credit card number and/or social security number), that information is encrypted and is protected with the best encryption software in the industry - SSL. This uses 128 bit encryption, the highest currently commercially available. While we use SSL encryption to protect sensitive information online, we also do everything in our power to protect user-information off-line. All of our users’ information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example our Online Print Service team) are granted access to personally identifiable information. The servers that store personally identifiable information are in a secure environment.
